T-Mobile has claimed victory Monday in a trademark lawsuit against Aio Wireless company, an AT&T subsidiary, for use of the color magenta in their promotions.
The Washington Post reports:
The Texas court has ordered AT&T to stop using Pantone 676C, a.k.a "plum," over fears that it might cause consumers to confuse the two brands. According to the presiding judge, T-Mobile successfully argued that letting Aio continue to use a variant of magenta would cause it irreparable harm. Aio Wireless has already discontinued the use of the color, and Alejandro Arango, spokesperson for the company, says the ruling will not affect future marketing plans.
T-Mobile said that the use of its color was a clear case of infringement.
